Acceptance of Terms
By accessing or using Corka (the "Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Service.
Definitions and Interpretation
"Venue" means any establishment listed on the platform. "Venue Owner" refers to the account holder listing and managing a Venue. "Guest" or "Customer" refers to users submitting deposit requests. "Service" refers to the Corka platform handling deposits, payments, and communications.
Service Description
Corka provides a digital corkage solution enabling Guests to deposit drinks at participating Venues. The Service facilitates the connection between Guests and Venue Owners, processes payments, and manages deposit records through QR code verification.
Eligibility
You must be at least 18 years of age to use the Service. By using Corka, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Customer Terms
Guest Registration and Account Security
To make use of the Service you must provide accurate registration information, keep credentials secure, and report suspicious activity immediately. You are responsible for all activities that occur under your account.
Guest Responsibilities and Conduct
Guests must follow applicable laws, respect Venue rules, act respectfully toward staff and other guests, and avoid prohibited behavior including any fraudulent use of the deposit system.
Bookings, Payments, and Deposits
All payments, deposits, and booking confirmations must flow through the platform and follow the Venue Owner's disclosed policies. Deposits are processed securely through Stripe. You agree to pay all fees associated with your deposits.
Cancellations and Refunds
Cancellation, refund, and rescheduling policies depend on the Venue Owner's selected terms. Guests must review those policies before confirming a deposit. Refund requests are subject to the applicable venue policy and platform terms.
QR Code Usage
QR codes issued for deposits are for your personal use only and may not be transferred, shared, or reproduced. Misuse of QR codes may result in account suspension and forfeiture of deposits.
Venue Owner Terms
Venue Owner Acceptance
By listing a Venue on Corka you agree to comply with these Venue Owner Terms and any related policies. Venue accounts require approval before activation.
Listing Requirements and Representations
Venue Owners represent that they have the authority to offer the Venue, that the information is accurate, and that photos and pricing are current. False or misleading information may result in listing removal.
Venue Owner Obligations
Venue Owners must maintain the Venue in safe condition, respond promptly to Guest requests, keep capacity and availability data accurate, and honor all confirmed deposits.
Financial Terms and Fees
Venue Owners agree to pay applicable service fees, respect payout timelines, and remit taxes or charges required by law. Fee schedules are disclosed during registration and may be updated with notice.
Deposits, Security, and Damage Claims
Venue Owners may set deposit requirements and must document claims for damages within the published timeframe. Guest disputes will follow the platform's stated process.
Cancellations and Modifications
Venue Owners must honor cancellations, refunds, or reschedules in accordance with their disclosed policy and notify Guests and Corka of material changes to venue availability or terms.
Legal
Privacy and Data Handling
Our Privacy Policy governs how user data is collected and processed. Venue Owners must protect Guest data in compliance with privacy laws and use personal information only for legitimate booking purposes. All users consent to necessary communications relating to deposits, changes, and safety notices.
Intellectual Property
The Service, including its design, features, and content, is owned by Corka LTD and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.
Limitation of Liability
To the maximum extent permitted by law, Corka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Corka, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Pending deposits and payments will be handled according to our refund policy.
Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms and updating the effective date. Your continued use of the Service constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
